The scalding parents from Yonkers plead guilty.
David Maldonado Sr. pleaded guilty to two felony counts of second-degree manslaughter and one of third-degree criminal possession of a weapon, and Luz P. Arroyo, also known as Lucy Cruz, pleaded guilty to two felony counts of criminally negligent homicide in the deaths of Elijaha Santana and his half brother, David Maldonado Jr.
Elijaha was two weeks shy of his third birthday and David was 20 months old when the elder Maldonado placed them both into a tub in their apartment at 77 Locust Hill Ave., turned on the hot water, then passed out to sleep off a drug binge. Arroyo was also sleeping after doing drugs.
Second-degree manslaughter is punishable by a maximum of 5 to 15 years in prison, while criminally negligent homicide carries a maximum of 1 1/3 to 4 years. Sentencing is scheduled for April 11 before acting state Supreme Court Justice Richard Molea.
This was senseless & disgusting to happen to the children. We need Parents who take the real responsibility of being a parent. We need parents who are ready to be parents. We also need to reform the way that CPS does business. But that was where the District Attorney’s office works with DSS. Hopefully, Janet is a team player, unlike Jeanine Pirro. Our children don’t deserve less protection. They deserve more protection. Elected Officials need to do more to put laws in place to protect children from abuse. We also need to protect children from bad parents.
